On the 2nd of September 2020 acting Minister for Immigration Citizenship, Migrant Services and Multicultural Affairs, Alan Tudge, released a media statement announcing a new Priority Migration Skilled Occupation List (PMSOL). The list indicates 17 occupations and applicants who hold visas in those occupations, will be able to enter Australia during the current COVID-19 pandemic.The new PMSOL list aims to support Australia’s economic recovery by allowing health care, construction and IT sponsored skilled workers to return to Australia to fill urgent skills needs in vital sectors. The Acting Minister mentioned that visa holders (such as subclass 482, 494 and 186) can request an exemption to travel to Australia. When the exemption is granted, visa holders will be subject to a 14 days quarantine on arrival at their own expense.

The new priority list has also strengthened the labour market testing requirements. Currently, for a 482 nomination application to be approved, employers need to provide evidence that they have tested the local labour market (unless exempt due to International Trade Agreements). Labour Market Testing must be conducted for a minimum of 4 weeks including job advertisements being drafted as per prescribed criteria.
