What is a Partner Visa?

If your spouse or partner is an Australian citizen, settled permanent resident, or eligible New Zealand citizen living in Australia, you might be eligible to apply for the Partner Visa. The Partner Visa allows you to live in Australia temporarily and permanently. Partner Visas comprise of Subclasses 309 & 100 which are for overseas applications and 820 & 801 which are for onshore applications.

 

Am I eligible to apply for the Partner Visa?

What are the Partner Visa requirements? You may be eligible if you meet the following requirements

  • you are 18 or older when you apply.
  • you are a spouse or partner of an Australian citizen, permanent resident or eligible New Zealand citizen living in Australia for more than a year.
  • you do not have any previous visa cancellations and have complied with conditions of your previous visa.
  • you meet health and character requirements.

 

How to apply for the Partner Visa?

In order to obtain a permanent Partner Visa, first, you need to apply for the temporary 820 Visa or Provisional 309 Visa. Temporary visas will allow you to stay in Australia until the decision of your permanent visa is made and it generally takes 2 years.

 

How long does it take to get a Partner Visa?

The Department assesses applications on a case-by-case basis and processing time can vary. Completing the application with the necessary documents, responding to any requests quickly and providing required information can help expedite the process.

The Department visa determines the cost of the visa according to the subclasses.

The visa types that you may apply for

PARTNER VISA (Subclass 309)

You may be eligible to apply for a Partner Visa if you want to migrate to Australia. Once granted, the Partner (Provisional) Visa will allow you to live, study and work in Australia temporarily until your permanent Partner Visa decision is made. You must be outside Australia when you apply for the 309 Visa.

PARTNER VISA (Subclass 100)

You may be eligible to apply for a Partner Visa if you want to migrate to Australia. Once granted, the Partner (Provisional) Visa will allow you to live, study and work in Australia permanently. You must be outside Australia when you apply for the 100 Visa.

PARTNER VISA (Temporary) (Subclass 820)

You may be eligible to apply for a temporary Partner Visa if you intend to live in Australia with your husband/wife or your de-facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Once granted the visa you can live, study and work in Australia until your permanent Partner Visa decision is made. You must be in Australia when you apply for the 820 Visa.

PARTNER VISA (Permanent) (Subclass 801)

You may be eligible to apply for a permanent Partner Visa if you intend to continue to live in Australia with your husband/wife or your de-facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Once granted the visa you can live, study and work in Australia permanently. You must be in Australia when you apply for the 801 Visa.
