Key Takeaway: The Application for Personal Injury Benefits is the first claim you lodge after a NSW car accident, under the Motor Accident Injuries Act 2017. It pays weekly income support and treatment, whoever was at fault. The deadline to lodge is 3 months. Lodging within 28 days backdates weekly payments to the day after the accident.

Application for Personal Injury Benefits: Quick Answers

How do I apply for personal injury benefits through SIRA?
Apply online through Service NSW with a MyServiceNSW Account, which sends your claim into SIRA’s system, or email or post SIRA’s Application for Personal Injury Benefits form to the CTP insurer. Attach a Certificate of Fitness from your treating doctor. The deadline to lodge is 3 months from the accident. CTP Assist can help on 1300 656 919.
What evidence do you need for a personal injury claim?
For a NSW personal injury benefits claim: a police event number (Police Assistance Line, 131 444), a Certificate of Fitness from your treating doctor, accident and vehicle details, and payslips from before and after the crash if you claim income support.
How long does a personal injury claim take to pay out?
Personal injury benefits start within weeks. The insurer confirms your claim within 3 days and decides on treatment, care and income support within 4 weeks, as set out in our NSW CTP claim guide. A lump sum is a separate common law damages claim and usually settles 12 to 18 months after the accident.
What is the average settlement for pain and suffering?
Pain and suffering is not a personal injury benefit. In NSW it is only paid through a separate common law damages claim, if your whole person impairment (WPI) is more than 10%, capped at $712,000. That requires a non-threshold injury (a break, fracture, nerve damage, or PTSD etc) and not being mostly at fault. A threshold injury (soft tissue injuries and undiagnosed psychological conditions etc) limits benefits to 52 weeks with no lump sum.

A car accident turns ordinary weeks upside down: appointments, time off work and bills that keep arriving while you recover. Paperwork is the last thing you need.

The thing most people miss is that this claim has two clocks. You have 3 months to lodge, but lodging within 28 days is what backdates your weekly payments automatically. This guide covers the benefits claim only. If your injury is serious, a lump sum claim can follow: see the Application for Common Law Damages.

What is the Application for Personal Injury Benefits in NSW?

It is the claim form for statutory benefits after a NSW motor accident: weekly income support plus treatment and care. You can claim even if you caused the crash. It applies to accidents from 1 December 2017 under the Motor Accident Injuries Act 2017. Lodge online through Service NSW or on SIRA’s Application for Personal Injury Benefits form.

It is the first of two claims in the NSW CTP scheme. Which ones you need depends on your situation:

Your situation Personal injury benefits Common law damages
You need time off work or treatment Yes, lodge within 3 months Not needed for this
You were mostly at fault, or you only have a threshold injury Yes, up to 52 weeks Not available
You have a non-threshold injury and were not mostly at fault Yes, lodge first Yes, within 3 years (how to lodge it)
You want compensation for pain and suffering Not covered Only if WPI is more than 10%

For the full journey from accident to payout, see motor vehicle accident injury claims.

Who can lodge an Application for Personal Injury Benefits after a car accident?

Anyone injured in a motor vehicle crash in NSW, regardless of who was at fault (Service NSW): drivers, passengers, motorcycle riders and pillion passengers, pedestrians and cyclists. Fault affects how long benefits last, not whether you can claim.

What does the Application for Personal Injury Benefits pay for?

Weekly income support if you cannot work, and reasonable and necessary treatment and care (SIRA).

  • •Weeks 1 to 13: up to 95% of your pre-accident earnings
  • •From week 14: up to 85% if you are working in a reduced capacity, or 80% if you are not working
  • •Treatment and care: costs such as your GP, hospital, physio, surgery and rehabilitation

Example: on $1,500 a week before the accident and unable to work, income support would be up to $1,425 a week for 13 weeks (95%), then up to $1,200 a week (80%). This is an illustration only; maximum weekly amounts apply.

How long do personal injury benefits last in NSW?

Your situation Weekly payments Treatment and care
Mostly at fault, or threshold injury only Up to 52 weeks Up to 52 weeks
Non-threshold injury, not mostly at fault, no damages claim Up to 104 weeks (2 years) Continues while reasonable and necessary
Damages claim pending, WPI 10% or less Up to 156 weeks (3 years) Continues while reasonable and necessary
Damages claim pending, WPI more than 10% Up to 260 weeks (5 years) Continues, including after settlement

These limits come from the Motor Accident Injuries Act 2017 and are confirmed by SIRA. To keep weekly payments running past 2 years, lodge your Application for Common Law Damages within 2 years. Whether your injury is threshold or non-threshold is the insurer’s first call: see threshold vs non-threshold injury in NSW.

What is the deadline for an Application for Personal Injury Benefits?

3 months from the accident to lodge. The 28 days is not the deadline to claim; it is the deadline for automatic backdating.

When you lodge Can you lodge? Are weekly payments backdated to the day after the accident?
Within 28 days Yes Yes, automatically. No explanation needed.
After 28 days, within 3 months Yes, on time. No explanation needed to lodge. Only with a full and satisfactory explanation, which is accepted if the insurer does not reject it within 14 days. Without one, payments start from the date of your claim.
After 3 months Only with a full and satisfactory explanation, and within 3 years (no 3-year limit for a death or impairment more than 10%) No. Payments start from the date of your claim.

The next deadline, for a lump sum, is 3 years: see how long after a car accident you can claim.

How do you lodge the Application for Personal Injury Benefits?

  1. Get a police event number from the Police Assistance Line, 131 444. Record details, witnesses and photos.
  2. Consult your treating doctor for a Certificate of Fitness, which you need to lodge. Tell them about all your symptoms, including psychological ones. We are lawyers, not doctors, so medical decisions are theirs.
  3. Find the at-fault vehicle’s CTP insurer, not your own, using SIRA’s CTP Connect.
  4. Complete the application. Missing details can be added later.
  5. Lodge it with your evidence through Service NSW, with the insurer, or by email or registered post. Attach your police event number, Certificate of Fitness, medical receipts and payslips. Keep a copy.

Each Certificate of Fitness normally covers up to 28 days, so keep new ones coming while you are off work. Step-by-step detail: our NSW CTP claim guide and what to do after a car accident.

What happens after you lodge an Application for Personal Injury Benefits?

After lodging What the insurer does
Within 3 days Confirms receipt and gives you a claim number
Within 4 weeks Decides on treatment, care and income support
Within 9 months Decides fault and whether your injury is threshold or non-threshold

Disagree with a decision? Ask for an internal review, then apply to the Personal Injury Commission. The threshold decision matters most: it can cap benefits at 52 weeks and rule out a lump sum.

Can you lodge an Application for Personal Injury Benefits and a common law damages claim together?

Yes. They run side by side, with the same insurer. With a non-threshold injury and someone else at fault: lodge the benefits claim within 3 months, lodge the Application for Common Law Damages within 2 years to keep weekly payments running (3 years is the deadline), then settle once your injuries stabilise.

Brad, a Withstand Lawyers client rear-ended at a red light, received statutory benefits during his claim and then settled for $400,000. More on our claims won page and NSW car accident compensation payouts.

Can you claim TPD as well as personal injury benefits if you cannot return to work?

Yes. If your injuries mean you are unlikely to work again, you may also be able to claim total and permanent disability (TPD) insurance through your superannuation. It is a separate claim against your super fund’s insurer, not the CTP insurer, and making it does not affect your other compensation entitlements.

  • •Whether you qualify depends on your policy’s TPD definition, usually whether you can return to any work you are reasonably qualified for by education, training or experience.
  • •You may be able to claim from every super fund that held TPD cover for you when you were injured, even if you have since stopped working.
  • •Lump sums generally range from $40,000 to $350,000. Insurers usually decide within 3 to 12 months of receiving all documents (how long a TPD claim takes).

Emma, a retail assistant, lost control of her motorbike in a head-on crash she caused and could not return to her job. Her super’s insurer paid her a $160,000 TPD lump sum within 5 months. Some Withstand Lawyers clients have received a car accident payout and a TPD payout. Talk to our TPD lawyers or read the TPD claim process guide.

Application for Personal Injury Benefits FAQs

Is there a fee to lodge the Application for Personal Injury Benefits?
No. The SIRA form and the Service NSW online claim are free, so lodging costs $0. If you want help, Withstand Lawyers works on a no win, no fee basis, so there are no upfront costs. See how no win no fee car accident lawyers work, or start with a free injury claim check.
Can I claim personal injury benefits if the accident was my fault?
Yes. Benefits are paid whoever was at fault, so a driver who caused the crash can still claim income support and treatment. If you were mostly at fault (more than 61%), benefits stop at 52 weeks and there is no lump sum. If someone else was at fault, read our guide to a not at fault car accident claim.
What is a Certificate of Fitness for a CTP claim?
It is a SIRA form your treating doctor completes, stating your injuries and your capacity for work. You need one to lodge, and it goes in with the claim. Each certificate normally covers up to 28 days, so you will need new ones for as long as you are off work or on reduced hours.
What if I don’t know which CTP insurer to claim against?
The claim goes to the CTP insurer of the at-fault vehicle, not your own, which you can find from its registration. Use SIRA’s CTP Connect tool or call CTP Assist on 1300 656 919, which can also help in harder cases such as a single-vehicle crash or a hit and run accident.
What if the insurer decides my injury is a threshold injury?
That decision limits your benefits to 52 weeks and rules out a lump sum. You can ask the insurer for an internal review, then apply to the Personal Injury Commission. Our guide explains the review window and how a tear or a diagnosed psychiatric illness can change the outcome: threshold vs non-threshold injury.
