Frequently Asked Questions

How long does a compensation claim take?

I hate writing or saying how long is a piece of string, but unfortunately until we take the time to speak to you and understand your injuries and the treatment plan set out for you, it really is dependant on many factors. Each claim is different. The duration that a claim takes to finalise depends on the claim and the law that applies. Generally, our compensation lawyers settle our clients’ claims in 12-18 months unless they have had surgery which extends the time frame or the matter needs to proceed to the personal injury commission or court, again depending on the claim and law that applies.

What questions should I ask a compensation lawyer about my claim?

When you speak to a compensation lawyer about your claim (or potential claim) you should walk away with all the information you need to know where you stand. In our opinion if you feel more confused or cant answer questions to your partner about what the lawyer said, you probably should have another consultation with that same lawyer, or of course, speak to us instead.  Here are 5 questions that we think will help you understand your claim better:

  1. Whether you are entitled to compensation benefits or not
  2. What your entitlements are and the process involved, regarding your injury compensation claim
  3. What time limits apply for your compensation claim
  4. What the costs and disbursements are for legal service
  5. The estimated time it will take to settle your compensation claim
What claims do you focus on?

Our compensation lawyers focus on:

  • Motor Vehicle Accident Claims
  • Workers Compensation Claims
  • Total and Permanent Disablement Claims
  • Medical Negligence Claims
  • Public Liability Claim
How much will a compensation lawyer cost me in Sydney?

No of course not but context matters. What that means is it really depends on the terms and conditions between you and your compensation lawyer, regardless of their location or how good the view from their office is!

We know that legal fees can be a scary thought. After all, we’ve all heard horror stories about people in horrible situations being left with out of pocket and in the minus.  That is why it is so important you understand all the details of your claim including the costs and no win no fee policy of the lawyer you have representing to you.

As for us, wee act for our client’s on a No Win No Fee basis, which means you pay nothing upfront. We also fund the disbursements related to your claim, so we can obtain the evidence required, which means you pay nothing out of pocket. We only get paid for our professional costs and disbursements if you’re successfully awarded compensation.

We also provide a No Win No Fee cost and disclosure agreement that clearly outlines our policy along with simply understandable details, so there are no surprises when we get you the compensation you deserve. We work hard to ensure you clearly understand our costs and the legal process.

When do I need a lawyer for my compensation claim?

It is never too early to know where you legally stand, especially because compensation lawyers offer free consultations. Our team of compensation lawyerscan advise you from beginning to end. Assessing your situation is crucial before making any compensation claim. Having advice that is tailored to your specific situation, such as the seriousness of your injury,  liability, your age a” will determine the extent of benefits that you may be entitled to. Our team of compensation lawyers, including theSydney team can guide you through the whole process of making a claim, providing critical information on what you can claim and how to claim it.

You can speak to one of our lawyers at any time before or during your claim, whether its to seek direction and advice, or to get a second opinion. Its never to early to get advice but it can definitely be too late as strict time limits apply to all compensation claims.

I am injured, what are the time limits to make acompensation claim?

Each state has its own law, and in New South Wales different time limits apply depending on the type of claim. We recommend that you speak to our experienced compensation lawyers to get legal advice and find out the time limits that apply depending on your compensation claim type..

Here are two types of compensation claims that have the most time limits in the shortest period of time since the accident. If you were injured in a motor vehicle accident then there is a 28 time limit to submit a claim form to the relevant greenslip insurer of the vehicle at fault to claim backpay on wages, otherwise its 3 months to lodge the claim form. For workers compensation claims, there is a 6 month time limit from the date of your injury to lodge the relevant work injury claim form by email or in person to your employer.  Another important time limit is commencing court proceedings, where you have 3 years from the date of injury, however that limit may be extended in special circumstances.
